Regulation and Legislation

Jersey continues to strive toward tighter regulation and continually amends policy to ensure the Island remains compliant with the latest international standards and regulations. As part of its commitment to the safety and stability of the Island’s economy, the Government has introduced a Sound Business Practice Policy (SBPP) and was one of the first jurisdictions to adopt anti-Base Erosion Profit Shifting (BEPS) stance. 

The SBPP is designed to protect Jersey’s reputation and integrity in commercial and financial matters and aims to act in the best economic interest for the Island. The SBPP applies to businesses which carry out activities that the Jersey Financial Services Commission (JFSC) considers sensitive, and which pose a potential reputational risk to Jersey. It is not exclusive to businesses regulated by the JFSC (financial services) but also applies to a selection of un-regulated activities. Included in this is any business with involvement, directly or indirectly, in mining, drilling or quarrying for natural resources. These activities are not considered inherently unlawful but are considered to potentially pose a reputational risk to Jersey and therefore require more scrutiny. 

BEPS is a consideration for all international businesses in Jersey. BEPS also known as Economic Substance refers to tax planning strategies that exploit holes and disparities in tax rules to artificially move profits to low or no-tax locations in which there is little or no economic activity. The BEPS initiative aims to stop this, to create a globally fair and modern international tax system by ensuring profits are being taxed in the jurisdiction where the profit generating activity takes place.
